Petros Sibanda (44) and Vemani Mudimba (44) both of Mkhosana, pleaded not guilty to charges of fraud when they appeared before magistrate Sharon Rosemani.

Prosecutor Listen Nare told court that on November 13, 2014, the accused persons connived to change the price of a cake from $34 to $10, prejudicing TM Supermarkets, represented by Nyatwa Chitakasha.

During trial, Sibanda said he believed the supermarket’s foreman identified as Moyo wanted to shift blame to them for an offence he committed.

“We were not in good books with Moyo and the branch manager because at one point we questioned them on an issue of baking products worth $1 500, yet their sales reflected $800,” he said

Sibanda said the incident created tension and the working environment was no longer conducive.

He told court that on November 13, he baked a cake and priced it at $10 on instructions from his foreman, Moyo.

“Around 2pm Vemani came and told me that the cake that was booked by Moyo was his,” Sibanda said.

“I helped him fold the cake box and we left it in the cold room for him to collect later.”

Sibanda said he was called back to work when he was on his way home and accused of wrongly pricing the cake worth $34 at $10 leading to his dismissal.

Mudimba told court that he asked the branch manager to place the cake order of $10 on his behalf because the bakery department had refused to bake the cake for him when he placed the order himself.

“When l got to the till, l was told that the cake could not be $10 and the manager told me it was $34,” he said in his defence.

“I was accused of having stolen the cake.”

The trial continues today.-Southern eye
