HIGH Court judge Justice Chinembiri Bhunu yesterday reserved judgment in a case where Zapu leader and former Home Affairs minister Dumiso Dabengwa is seeking enforcement of the Constitution in relation to the holding of elections.
Dabengwa filed the application at the Electoral Court through his lawyers Tererai Mafukidze and Bryant Elliot. After hearing submissions by Dabengwa and Zimbabwe Electoral Commission (Zec) lawyers, Justice Bhunu reserved judgment in the case.
In his submissions, Dabengwa said it was mandatory for the inclusion of a constitutional clause which entails the holding of the elections in the country to be enforced before any elections could be held. Dabengwa’s applications comes at a time when the country was preparing to hold by-elections in 14 constituencies which fell vacant when Parliament expelled 21 former MDC-T legislators for crossing the floor to join the MDC-Renewal Team.
Dabengwa is also seeking to have various provisions of the Constitution, such as those providing for Zec to register voters and to compile the voters’ roll to be given effect forthwith.
Most opposition parties in the country have boycotted the by-elections citing non-implementation of electoral reforms although Zapu has fielded candidates in all constituencies in Bulawayo ahead of the June 10 by-elections.
