Blow as Court throws out Mliswa by-election case

The Electoral Court of Zimbabwe has dismissed with costs a petition by losing Hurungwe West candidate Temba Mliswa to have election results that were won by Keith Guzah nullified.

 

In his judgement, on Friday, Justice Uchena declared Keith Never Guzah the duly elected member of the National Assembly for Hurungwe West constituency.

The Hurungwe West by-elections were held on the 10th of June and Guzah who represented Zanu PF was declared winner the following day.
Mliswa, who stood as an independent was, however, aggrieved and petitioned the electoral court to nullify the results.
The electoral court, however, found out that Mliswa’s petition is fatally defective and is therefore a nullity for want of compliance with the electoral application, appeals and petitions rules 1995.
