Victimisation continues as warrant of arrest is issued for Wadyajena after his case was dismissed in Victoria Falls

Gokwe Nembudziya member of the National Assembly,  Justice Mayor Wadyajena has been issued with a warrant of arrest following the legislator’s failure to attend trial at Victoria Falls magistrate court.

Wadyajena failed to attend the trial due to illness, on advice from his doctor, and despite his lawyer, Mr Givemore Muvhiringi presenting the doctor’s note to the magistrate, a warrant of arrest was issued.

He will be required to travel to Victoria Falls for an enquiry and remand once he has recovered.

Wadyajena was in January exonerated from criminally insulting the First Lady, Dr Grace Mugabe during last December’s Zanu PF conference held in Victoria Falls, but an alternative charge of disorderly behaviour, stated under Section 41 of the Criminal Law Codification and Reform Act, remained.

In January, Victoria Falls magistrate, Ms Lindiwe Maphosa acceded to the defence’s argument that the criminal insult was unconstitutional and eventually placed the legislator off remand.

However, Ms Maphosa dismissed an application by Wadyajena’s defence challenging an alternative charge of disorderly behaviour and was supposed to reappear in court today.
