BULAWAYO-Zimbabwe’s High Court has set a verdict date of April 24 following the urgent chamber application over the use of the MDC-T party symbol and name by Advocate Nelson Chamisa’s camp against Dr Thokozani Khupe’s faction.
The Tuesday decision by the Bulawayo High Court Judge Justice Martin Makonese follows a bitter fight between former MDC-T leader Morgan Tsvangirai’s deputies over who should lead the party. Tsvangirai, died aged 65 in South Africa after battling colon cancer for at least two years, but his condition deteriorated rapidly despite treatment.
The MDC-T camp led by Advocate Chamisa through their lawyers Atherstone and Cook Legal Practitioners made their submissions before the judge challenging the opposition of the application by Dr Khupe.

Advocate Chamisa’s MDC-T camp lawyer, Lucas Nkomo said according to the parliament’s mandate, Dr Khupe is not obliged to conduct a congress as she is expected to get clearance from the parliament’s secretariat.
On the other hand, Dr Khupe’s lawyer, Professor Lovemore Madhuku, argued that their rivals did not submit the MDC-T party’s constitution during the urgent application to the chamber claiming that they knew that Dr Khupe was the legitimate leader of the party.
If the appeal is accepted, it will put to rest the squabbles in the MDC-T party over the party’s legitimate leader.
